In May, a third letter, this time from Atteys compliance officer Mr GM Sampson, repeated the apology and offered a reduction of £200 each.
He told Alan and the others: “Money paid by way of a mistake is generally recoverable but, in recognition of the error, we are prepared to accept from you the sum of £1886.”
That brings us up to date, when eight of the 10 paid up. But Alan and one other have still not paid and Alan has been threatened with court action if he does not cough up by tomorrow.
Alan said: “Atteys said they would contact the estate administrator and advise her of court action against me. But she is an old lady and I don’t know if she wants all this hassle.”
A spokeswoman for the firm said Mr Sampson was not prepared to take my call.
There is no doubt Atteys made a mistake and the verdict is . . . guilty of being stupid. Perhaps it’s time for a change in the law so lawyers who make a cash mistake can’t claw it back.
