A spokeswoman for M&S said the sale was handled within the rules of the Financial Services Authority.
A spokeswoman for M&S Money said: “We have reviewed Mrs Ferguson's case and can confirm that it was handled completely within FSA regulations, so our decision remains the same.
“Mrs Ferguson received policy documents, giving details of eligibility, and signed the agreement for Payment Protection Insurance (PPI).
“In her email to the Sunday Sun she said she was already insured for being out of work when she took out the PPI policy.
“The PPI payments have been shown on her M&S card statements for the past nine years, but she has not queried the sale until recently.
“If she felt she did not need the insurance she could have cancelled it at any time.”
