“Obviously we are pleased this second appeal was rejected, but Gary Forster should not have even been allowed to get to that stage.

“He has got to face up to his punishment and his reckless stupidity.”

The accident happened on January 21 last year, when Forster was seen driving with “bully boy tactics”, tailgating other drivers, the court heard.

Forster completely failed to see Christopher, of Felling, Gateshead, who had been travelling at around 70mph when Forster’s car smashed into him. He fled the scene before hailing a passing taxi and hiding out at a friend’s house.

He later went to hospital where he told nurses that he had been involved in the smash, at which point police were called and he was arrested.

Mr Turnbull said he can never forgive Forster for taking away his son.

He said: “He was driving so fast in my opinion I think he was trying to kill himself when the crash happened.”

At Friday’s appeal hearing, judge Sir Geoffrey Grigson said: “The judgment of this court is that the sentence is entirely appropriate.”
